BMW Diesel swirl flap design was such that by opening and closing the length of the manifold could be lengthened/shortened and therefore torque output be altered. The engine runs with the flaps fully open so the tract is at its shortest except when idling. When these swirl flaps fail the metal fixings for them pass through the cylinders and destroy the engine/turbo. The effect of flap removal is minimal. The flaps are fully open whenever the car is off idle and when its idling their removal causes a minimal increase in emissions only. The holes left by removal need to be replaced/covered with something substantial to stop anything else or indeed the mod kit itself being sucked through the manifold into the engine.
